Please read them carefully before accessing and using the Services provided by AvatarGen.io. By accessing and using our Services, you indicate that you accept these terms of use and any other indicated rules, disclaimers, restrictions, terms and conditions provided in conjunction with the Services, agree to abide by them and agree that you are responsible for compliance with any applicable local laws and regulations. If you do not agree with any of these terms, please refrain from accessing and using our Services.
AvatarGen.io may revise these terms and conditions of service at any time without notice by updating the contents of this page. So you are requested to visit this page and check the then effective Terms of Service periodically. By using our Services you are agreeing to be bound by the then current version of these Terms of Service. The Terms of Service apply to you regardless of how you have accessed the API and regardless of the territory in which you live or conduct business.
AvatarGen.io Permission is granted to view, use and access the Services (free and premium services to which you have subscribed through applicable fees). You may use the API in both online and/or mobile applications/services. However, one single API key/subscription to one online and/or mobile application/service. AvatarGen.io may offer access to our API through a subscription for users who require access that would result in resale of AvatarGen.io Services or that require high-throughput access.
The contents of the Services, including any text and graphics are copyrighted and may not be modified or reproduced without the prior written consent of AvatarGen.io. If you are a Free API user, then you will credit AvatarGen.io by name or brand logo when using our API.

AvatarGen.io reserves the right to modify or terminate any of the services at any time. In our sole discretion, AvatarGen.io, will determine abuse or excessive usage of the API. Excessive frequent requests and abuse via the API may result in temporary or permanent suspension of your Account’s access to our API and we will make reasonable attempts to warn you prior to suspension. Further, if you violate the Terms of Service, your authorization to use our Services, automatically terminates and you must uninstall and destroy any materials in your possession and your account will be suspended.
Our Services are provided on an 'as is' basis. AvatarGen.io makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
We attempt to ensure accuracy and integrity of the content provided with our Services. The information provided by our Services could include technical, typographical, or photographic errors. Further, AvatarGen.io does not warrant or provide any guarantees regarding the accuracy, and reliability of the contents of our Services. It is possible that third parties could make unauthorized additions, deletions and alterations to the Services.
AvatarGen.io may make changes to the nature and content of the Services or may suspend or discontinue the services, at any time without notice. AvatarGen.io shall not be liable for any damages arising out of any alteration or change of the contents or inability to use this Service.
In no event shall AvatarGen.io or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of, or related in any way to, the use or inability to use the Services, information or content related to the Services, even if AvatarGen.io or a AvatarGen.io authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
We process information about you in accordance with our privacy policy. By using our API, you consent to such processing and you warrant that all data provided by you is accurate. AvatarGen.io collects the information you directly provide to us and through “cookies”. We may use this information for statistical analysis, improvement of our Services and identification of services of interest to you. Please review our Cookies Policy.
AvatarGen.io will but is not obligated to, monitor or review any communication spaces and the associated content, where users communicate with each other, including bulletin boards, chat rooms and forums. You may not engage in any abusive, defamatory, unlawful or otherwise inappropriate behavior on these spaces. AvatarGen.io reserves the right to remove, in its sole discretion, any content that is deemed abusive, defamatory, infringing, obscene or otherwise inappropriate. AvatarGen.io also reserves the right to revoke any access to these spaces through its Services. AvatarGen.io will not have any liability related to the content on communication spaces, whether or not arising under the laws of copyright, privacy, libel, obscenity or otherwise.
Beta Previews may not be supported and may be changed at any time without notice. They are not generally available for distribution and are not intended for use in a production environment but should only be used for testing purposes. The purpose of Beta Previews is to facilitate commercial availability of the Services and to obtain information on the quality, usability and customer experience of the API and related documentation and materials. Use of the Beta Preview, is at your own risk and users are subject to our general API Terms of Service.
You may obtain access to special information that is not available to the public through using a Beta Preview. You agree that any non-public information we provide will be considered AvatarGen.io’s confidential information (“Confidential Information”), even if it is not marked as such. You agree to only use Confidential Information for the sole purpose of testing and evaluating the Beta preview. You agree to use the same degree of care you would with your own confidential information to prevent any unauthorized access, use, or dissemination of Confidential Information and will not disclose such to any third party not authorized by AvatarGen.io. If you are required to release Confidential Information pursuant to operation of law, provided AvatarGen.io has been given reasonable advance written notice to object, unless prohibited by law, you will not be in violation of the terms of this Agreement.
You will be asked to provide feedback as a user of a Beta Preview. Providing feedback helps us to improve our products and services. If you choose to provide feedback, including but not limited to, ideas, algorithms, code, know-hows, enhancements, recommendations and other information about our products and Services (“Feedback”), you acknowledge and agree that AvatarGen.io will have a fully paid-up, royalty-free, transferable, worldwide, sub-licensable, perpetual and irrevocable license to use, modify, implement, commercially exploit and /or incorporate the Feedback into our Services and documentation.
You understand and agree that using a beta preview is voluntary and you certify that you are of the legal age of majority in the jurisdiction in which you reside (at least 18 years of age in many countries).
AvatarGen.io reserves the right to modify the terms, conditions, and policies surrounding Beta previews at any time, and to revoke your participation, at any time. AvatarGen.io will communicate such changes to the terms and conditions through email contact.
AvatarGen.io has not reviewed all of the sites you may access through our Services and make no representations whatsoever about those sites. AvatarGen.io is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by AvatarGen.io of the site. Use of any such linked website is at the user's own risk.
These terms and conditions are governed by and construed in accordance with the laws of USA and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location. You represent that you are of legal age, 16 years or older, to enter into contracts and have full authority and competency to enter into and be bound by these terms and conditions of service.
